RACQ Privacy Collection Notice – Job applicants


About this privacy notice

This Privacy Collection Notice lets you know how RACQ Operations Pty Ltd (ABN 80 009 663 414) and its related entities (‘RACQ’, ‘we’, ‘us’, ‘our’) collect, use and disclose personal information about people who apply to work with us. 

“Personal information” means information or an opinion about an individual who is identified, or who can reasonably be identified from the information. 

To find out more about how RACQ handles personal information, including information about people other than its job applicants, you can also review RACQ’s Privacy Policy at https://www.racq.com.au/privacy or you can request a copy from us. 

The RACQ Privacy Policy also sets out how you can access personal information we hold about you and seek correction of this information. It also explains how you can complain about a breach of the Privacy Act 1988 (Cth) and how we will deal with your complaint.


How personal information is collected

RACQ generally collects personal information about you (as a job applicant):

  • from you, such as when you complete an application in RACQ’s recruitment system (including providing copies of your identity information such as your driver’s licence);
  • in the course of your interview. Where you give consent, artificial intelligence may be used to collate interview notes;
  • passively, such as via CCTV recording when if you visit one of our RACQ locations during your recruitment process; and
  • from the following third parties: 
    • your previous employers and nominated referees;
    • our pre-employment medical screening providers;
    • your educational/membership institutions;
    • from publicly available sources, such as  Seek, LinkedIn and other social media platforms;
    • various Australian police registers for criminal history information;
    • the Australian Securities and Investments Commission (ASIC) and Australian Prudential Regulation Authority (APRA) registers to verify whether you are banned or disqualified, have any current shareholdings or directorships or hold an Australian Financial Services (AFS) licence (where relevant to the work you may be doing);
    • the National Personal Insolvency Index to determine whether a person is or has been subject to bankruptcy, a Part X agreement, a Part IX debt agreement or some other proceeding under the Bankruptcy Act 1966 (Cth) which may expose RACQ to a business risk;
    • various Australian court judgments to check for court actions which may expose RACQ to business risk;
    • various Australian and international government published watch lists and politically exposed persons lists; and
    • various government databases for driving and traffic history and Australian Home Affairs and Immigration for visa conditions.

 

Other methods of collection depend on your interactions with us, and are described in the RACQ Group Privacy Policy. 


Laws authorising collection

We are required or authorised to collect and disclose personal information about you under the following laws (and associated regulations):

  • Fair Work Act 2009 (Cth); and
  • Migration Act 1958 (Cth) – if we are your work sponsor,

and depending on the role for which you are applying, we may be required to collect and disclose your personal information under:

  • the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth);
  • the Australian Investments and Securities Act 2001 (Cth);
  • the Financial Accountability Regime Act 2023 (Cth);
  • the Corporations Act 2001 (Cth);
  • banking and insurance laws; and
  • legislation about working with children and vulnerable persons.

Consequences of not providing personal information

If you do not provide the personal information we have requested, we may not be able to assess your application or make an offer of employment to you.


Purposes of collection of personal information

Personal information collected in your job application and in the course of your recruitment is collected for the primary purpose of assessing your application for employment, making an employment offer if we choose to do so and, if you accept any such offer, for purposes relating to your employment.

We will only use and disclose your personal information for the purpose for which it has been provided, a purpose set out in this Privacy Collection Notice, reasonably expected and related secondary purposes, other purposes you have consented to, or any other purpose permitted by law. 

We may also use and disclose your personal information for the following additional purposes:

  • verifying your identity;
  • where you are an unsuccessful job applicant, to consider you for further roles, including contacting you in relation to opportunities;
  • for administrative, accounting, audit, insurance, management, training, planning, record keeping, archiving, risk management and other business purposes of RACQ;
  • to monitor the security of our premises; and
  • on other bases permitted by law, including for law enforcement purposes. 

Disclosure of personal information

We may disclose information to:

  • our related companies, including the entities that form part of the RACQ Group, and its retail agents;
  • our service providers, such as those that perform background check services for us;
  • disability providers and government agencies in connection with government funding programs;
  • our professional advisors, such as accountants, lawyers and auditors; and
  • government agencies, where required by law.

Overseas disclosures

We may disclose your personal information overseas. Please see our RACQ Overseas Disclosure list at https://www.racq.com.au/privacy/racq-overseas-disclosure for countries that RACQ may disclose your personal information to in the ordinary course of its business. There may be other countries to which your personal information may be disclosed to conduct the application assessment and pre-employment processes (including background checks) described in this collection notice, depending on the jurisdictions that are relevant to you.

If we do disclose this information outside Australia, we will do so on the basis that the information will be used only for the same purposes for which we are permitted to use your personal information.

Personal information you give us about third parties

If at any time you supply us with personal information about another person (for example a referee), you represent that you are authorised to do so; and you agree to inform that person who we are, how to contact us, and how to obtain our Privacy Policy which sets out how we may use their personal information.


Security

We take reasonable steps to ensure that your personal information held on our website or otherwise, is protected from:

  • misuse, interference and loss, and
  • unauthorised access, disclosure or modification.

We ask you to keep your passwords and personal identification numbers safe, in accordance with our Terms and Conditions.
